1. Overview
The information supplied below complies with rules set out within the Distant Selling Regulations. Please read these terms and conditions carefully before ordering any products from www.belgraviamarble.co.uk. It should be understood that by ordering any of the products from www.belgraviamarble.co.uk you are agreeing to be bound by the terms and conditions, confirming it by ticking the confirmation at on the cart page. When making purchase through our Customer Service team, by virtue of placing order it should be understood that you have agreed to the terms and conditions.
This website www.belgraviamarble.co.uk is owned and operated by Irk River Traders Ltd t/a Belgravia Marble.
The following terms and conditions (“terms”) apply to all purchases of products by you from www.belgraviamarble.co.uk that is operated by Irk River Traders Ltd whether your purchase is made through our Customer Service team or from this website. Please read them carefully. We may vary these terms from time to time and therefore you should check to ensure you have the latest version before you make a new purchase. The date on which the terms were last amended is shown below under General Information.
References in these terms “Belgravia Marble”, “www.belgraviamarble.co.uk”, “we”, “us” and “our” means Irk River Traders Ltd.
Your legal rights are not affected by these terms and conditions. Advice about your legal rights is available from your local Citizens Advice Bureau or Trading Standards.
2. The formation of a contract between Belgravia Marble and the Customer
Once an order has been placed with Belgravia Mable, you will receive an acknowledgment email.
Please be aware that this does not automatically mean that your order has been accepted.
The order from a customer constitutes an offer from you to Belgravia Marble to purchase a product. All orders are subject to an acceptance by Belgravia Marble, which will be confirmed by an email stating that the product has been dispatched. This will be known as the ‘Confirmation of Dispatch’ At this point a contract has now been formed between the customer and Belgravia Marble. Any contract between Belgravia Marble and the customer will only be formed when Belgravia Marble sends out the Confirmation of Dispatch to the customer.
The contract will relate only to the products that have been purchased, listed and confirmed within the Confirmation of Dispatch. Belgravia Marble is not obliged to supply any other products which may have constituted part of the order, until the dispatch of such products has been confirmed in a separate Confirmation of Dispatch.

3. Customer Status
By placing an order through Belgravia Marble, you certify that you are legally capable of entering into a binding contract.
You are at least 18 years old.

5. Payment
Belgravia Marble welcomes payments made using PayPal and Credit or Debit Cards on our website at www.belgraviamarble.co.uk and through our Customer Service team. However we only accept payment from the following Credit and Debit cards:

Payment by PayPal is accepted for ordering on the website and through our Customer Service team.
If you wish to make any change to your order, you can contact our Customer Service team via email customerservice@belgraviamarble.co.uk or contact us form. Any changes in the order however could delay the full order so please check when doing so by asking the customer service adviser.
In you wish to cancel an order or return your purchase, please contact our Customer Service team. Please refer to our Refund and Exchange terms in the section 11 for further details.
If we are unable to fulfil your order we will notify you and refund the monies within 14 days of its notification, to your original method of payment (i.e. credit card, debit card, PayPal or to a combination of payment methods as applicable).

6. Acceptance of order
For orders placed through our Customer Service team or online, you will receive an e-mail order acknowledgement. It is important that you provide a valid e-mail address at the time of purchase. Your order is only accepted when full payment is received by us.

7. Delivery
Estimated delivery times for all products will be displayed within the individual product information section on the Belgravia Marble website. Belgravia Marble will endeavour to make every effort to deliver all goods ordered within the stated timescale. However, there are rare occasions when delays can occur due to unforeseen circumstances outwitting our control such as bad weather etc. Belgravia Marble shall not be held liable for any delays in the order deliveries. An estimated delivery date will be confirmed in the Confirmation of Dispatch relating to your items in the order. If no delivery date can be confirmed or specified because goods are to be manufactured specifically to order, the product is temporarily out of stock, or deliveries are delayed due to bad weather, we endeavour to notify the affected customer of any potential delay unless there are exceptional circumstances.

8. Descriptions
At the time of publication on our website and in our catalogue, all product descriptions are believed accurate, errors and omissions excepted. We always take great care with the colours represented in our collections. However, the representations of colours in the images are approximate due to the photographic limitations and reproduction process. Moreover, the images appear differently on your device (phones, tablets and computers) due to different types of technologies, setting and light from the environment. All measurements and weights are approximate.
Whilst we endeavour to maintain advertised product colours and specifications during the lifetime of our catalogue, we reserve the right to change them and to discontinue particular products as we consider necessary. This will not affect any orders that have already been accepted.

9. Prices
The price of your product is that applicable at the time of purchase. Prices are inclusive of VAT at the rate applicable at the time of purchase. Previously viewed prices via cookies on your computer will not be honoured and requests to do so will be refused. Sale/ discounted prices are available only while the promotion runs and stocks last.

10. Your right to cancel under Distance Selling
10.1. Right to cancel
Where you purchase a product or a number of products together from our website or through our Customer Service team you have the right to cancel this contract within 14 calendar days after the date on which the product(s) was (were) delivered to you. Where multiple items form part of the same order but have been delivered separately, your right to cancel starts 14 calendar days after the date on which the last product(s) was (were) delivered to you by us.
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement through email.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. This right does not apply to any personalised product(s), to any product(s) which have been made or adapted to your requirements, to any product(s) which cannot be returned for hygiene reasons.
10.2. Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery at the standard delivery charge. In order to receive a full refund, all we ask is that you take reasonable care of the product(s) and that they are returned to us in the same condition and, to the extent possible, in the same packaging as when we delivered them to you. We may make a deduction from the reimbursement for loss in value of any product(s) supplied, if the loss is the result of mishandling by you.
We may withhold reimbursement until we have received the product(s) back. We will refund you without undue delay, and not later than 14 days from the day you return any products supplied, or provide us with evidence that you have returned them. The refund will be processed to the original form of payment used for the initial transaction, unless we have expressly agreed otherwise to an alternative.
You will be responsible for any postage or other costs incurred in returning the product(s) to us, except where goods might have been delivered to you in error or where the product is faulty or not as described.
If your order comprises of multiple items, you can cancel and return any of the items individually or in combination.

11. Our refund, exchange and returns policy

You automatically get a 14-day ‘cooling-off period’ when you make a purchase on our website or through Customer Service team. The cooling-off period starts as soon as you receive your order (goods delivered). This 14-day cooling-off period’ policy does not apply to the personalised, bespoke and made to measure products and other excluded products in Section 11.2. Exclusions.
11.1. Conditions

  • Applicable to purchases made online at belgraviamarble.co.uk or through our Customer Service team.
  • The product must not have been used and must be returned to us in a saleable condition and in its original, undamaged packaging.
  • Exchanges will be provided to a product of your choice, to the original purchase price where an email order confirmation is provided. Any price increase should be paid at the time of exchange and any price decrease will be refunded to the original form of payment.
  • Refunds will be processed to the original form of payment where an email order confirmation is provided.
  • Refunds will be processed in the same currency used for purchase.
  • Delivery charges will not be refunded.
  • For hygiene and safety reasons, items such as toiletries, underwear and swimwear.
  • Any item which has been made to order or personalised for you.

11.2. Exclusions
Nothing within this refund, exchange and returns policy affects your legal rights, and in particular you will always be entitled to return goods to us for a full refund if they were faulty or not as described and we cannot remedy the fault to your reasonable satisfaction.

12. Returning your goods
For your convenience, you may return any full priced or promotional product(s) purchased from our website or through our Customer Service team. You have to send the product(s) along with the email order confirmation with details of the products returned to the address provided by the Customer Service team.
Any postage incurred by returning un-damaged items to us will not be refunded. You are responsible for the return of the product in the original undamaged packaging, and in a saleable condition.
Please contact our Customer Service team who will be able to assist with the return. Where you are returning the item by post, you are recommended to use a form of delivery which includes insurance for the full value of the product in case it is lost or damaged in the post. We may refuse a refund or exchange where an item is lost or damaged in transit.
To ensure the safe return of your items, please package your item with care. We recommend that items valued over £50 are returned using a trackable delivery service and for items valued over £100 or more, we recommend that you insure your return for the value of the product and use delivery service that requires signature.

13. Warranties
Belgravia Marble offers a wide range of marble and natural stone products. All of our products are supplied with limited warranty. All of our products are physically examined for quality assurance prior to shipping.
Natural imperfections are characteristic of the stone products as the stone forms in natural conditions over millions of years. These imperfections are not defects in the material. Colours and patterns will vary from one piece of stone to another. No two pieces are exactly the same. So we cannot guarantee the colour or character of stone product delivered will be an exact match to any image or another product.
The surface of the stone is not totally smooth - there are pits, fissures, eyes, chips and gaps. These cannot be polished out, as it is the natural state of the stone. We reserve the right to use chemical or resinous fillers. Natural stone articles do sometimes incur slight variation in thickness which results.
13.1 Basins
This warranty applies to marble or stone basin correctly installed and carefully used. It does not cover any issue or damage caused by the workmanship of third party installers or DIY orders. The stone for your basin has been carefully selected from premium quality stone blocks to be free from defects and has been machined, prepared, polished, treated and approved by our craftsmen to ensure quality and integrity of the basins for many years to come with the right care and attention to maintenance.
Porosity is a natural characteristic of the natural stones; some stones are more porous than others. Therefore sealant must be applied to the basins before installation to resist staining. You will need to ensure a suitable sealer is re-applied regularly as appropriate. However, this does not mean they are guaranteed not to stain. Care should be taken to ensure that materials likely to cause staining (such as acidic fruit like lemon, lime, vinegar based sauces, abrasive cleaning products, bleach etc.) are kept away from direct contact with the basin.
13.2 Kitchen Accessories & Ornaments
All kitchen accessories and ornaments are made from high quality marble stone. We may think of natural stone as a hard impermeable material but it is in fact porous so to prevent stains from being absorbed sealing the stone with a quality impregnating sealer is essential and will prevent most spills from damaging it. However, this does not mean they are guaranteed not to stain. Care should be taken to ensure that materials likely to cause staining (such as acidic fruit like lemon, lime, vinegar based sauces, abrasive cleaning products, bleach etc.) are kept away from direct contact with the marble stone items.
Any issues or defects must be reported in writing and accompanied with images via email to customerservice@belgraviamarble.co.uk within 2 days of the delivery. The buyer is deemed responsible to have examined and accepted the goods in good condition and free from any defects and supplied in accordance with all the specifications of the order.
In the rare event of you encountering a fault with any item purchased from us please email a description of the fault along with images (when possible) to customerservice@belgraviamarble.co.uk.
